Terms and Conditions

Welcome to Element Pro Restoration. These Terms and Conditions explain how you may use our website, https://www.elementpro.ca, and the conditions that apply when you contact us about our services.

In these terms, “Element Pro Restoration,” “we,” “us,” and “our” refer to the business operating this website. “You” and “your” refer to website visitors and people making enquiries.

1. Scope of These Terms

These terms govern your use of our website. Restoration work is subject to a separate service agreement, work authorization, or accepted quotation that sets out the agreed scope and conditions.

Submitting a website form or requesting an estimate does not, by itself, authorize work or confirm a service booking. If these website terms conflict with an agreed service contract, the service contract governs the work, subject to applicable law.

2. Website Information

Our website provides general information about residential and commercial restoration services, including fire, water, flood, sewage, wind and hail damage restoration, mould remediation, asbestos abatement, crime and trauma cleaning, and soft goods restoration.

Website content does not replace an inspection of your property or advice specific to your situation. The appropriate restoration approach depends on the damage, site conditions, safety requirements, and findings during assessment.

We aim to keep information accurate and current, but errors or omissions may occur. Please contact us to confirm information relevant to your project.

3. Emergency Enquiries

For urgent restoration assistance, call 780-645-7135. Please do not rely on a website form or email for an immediate response.

Emergency availability does not guarantee a specific arrival time. Response times depend on your location, weather, road conditions, site access, crew availability, and the nature of the incident.

If there is an immediate threat to life or safety, contact emergency services first. Do not enter an unsafe property.

4. Assessments, Estimates, and Changes

The scope, estimated cost, and expected schedule for restoration work will be addressed in your quotation or service agreement.

An initial assessment may not reveal all damage. Concealed moisture, contamination, structural damage, or hazardous materials may become apparent during the work.

Where additional work is needed, we will explain the proposed changes and obtain authorization as required by the service agreement and applicable law. Estimates and any changes to them remain subject to applicable consumer protection requirements.

5. Authorization and Property Access

Before authorizing services, you must own the property or have permission to approve the requested work.

Please provide accurate information about the incident, known hazards, previous damage, and any access restrictions. You must arrange authorized access to the areas included in the agreed work.

For everyone’s safety, follow site instructions and keep children, pets, occupants, and visitors away from restricted work areas. Do not move restoration equipment or remove containment barriers without approval.

6. Insurance Coordination

Where agreed and authorized, we may communicate with your insurer and provide information relating to the restoration work.

Your insurer determines coverage, claim approval, policy limits, and reimbursement. We cannot guarantee that an insurer will approve a claim or pay for all proposed work.

Responsibility for deductibles, uninsured work, and other charges will be addressed in your service agreement. Insurance coordination does not change the payment responsibilities agreed in that contract.

7. Payments, Cancellations, and Warranties

Payment schedules, deposits, applicable taxes, cancellation arrangements, and any express workmanship warranty will be set out in the relevant quotation or service agreement.

These website terms do not establish a fixed cancellation fee, non-refundable deposit, or blanket “no refunds” policy. Any charges or refunds must comply with your agreement and applicable law.

Nothing in these terms removes statutory cancellation rights, warranties, or other consumer protections.

8. Restoration Outcomes and Scheduling

Restoration results depend on the type and extent of damage, the condition of the property or belongings, and how long the damage has been present. Some materials or items may require replacement.

Schedules may be affected by drying times, testing, permits, material availability, insurer decisions, weather, or newly discovered damage.
Any project-specific commitments will be addressed in your service agreement.

Website photographs, examples, and testimonials illustrate individual projects or experiences and do not guarantee an identical outcome.

9. Acceptable Website Use

You agree to use this website lawfully. You must not:

  • Submit false, misleading, or unauthorized information.

  • Upload malicious software or attempt unauthorized access.

  • Interfere with the website’s operation or security.

  • Use contact forms to send spam, threats, or unlawful material.

  • Copy or use website content in a way that infringes intellectual property rights.

10. Intellectual Property

Unless otherwise identified, website text, branding, graphics, photographs, and other materials belong to Element Pro Restoration or their respective licensors.

You may view and print content for personal, non-commercial reference. Reproduction, modification, distribution, or commercial use requires permission from the relevant rights holder, except where permitted by law.

11. Privacy and Third-Party Links

Our Privacy Policy explains how we handle personal information collected through the website. Please avoid submitting unnecessary sensitive information through general enquiry forms.

The website may link to external websites or services. Their content, availability, and privacy practices are controlled by their respective operators. A link does not necessarily imply our endorsement.

12. Website Availability and Liability

We take reasonable steps to maintain the website, but uninterrupted or error-free access cannot be guaranteed.

To the extent permitted by law, we are not responsible for losses caused by website interruptions, technical errors, or reliance on general website information instead of a property-specific assessment.

Nothing in these terms excludes liability that cannot legally be excluded or restricts rights and remedies available under applicable consumer protection laws. Responsibility for restoration work is governed by the relevant service agreement and applicable law.

13. Governing Law and Disputes

These terms are governed by the laws of Alberta and the federal laws of Canada applicable there, subject to any mandatory protections that apply to you.

If you have a concern, please contact us so we can try to resolve it. This does not prevent you from making a complaint to a regulator, pursuing a court claim, or exercising another legal right.

14. Changes to These Terms

We may update these terms by posting a revised version with a new effective date. Changes apply prospectively and do not amend an existing service agreement without any agreement required by law.

If a provision is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
